These Terms of Use ("Terms") govern access to and use of the Gyeniusx platform, an AI-assisted study tool operated by YakshaTech. By creating an account or using our services, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy.
1. Definitions
"Platform": the website, applications, and digital services of the Gyeniusx brand, operated by YakshaTech.
"User" or "you": an individual who accesses or uses the Platform.
"Account": a personal, non-transferable registration created by the User.
"User Content": materials you upload (PDFs, videos, text, links, notes, chat messages, and other files).
"Generated Content": responses, summaries, flashcards, quizzes, and other AI outputs based on User Content.
2. Service description
Through the Gyeniusx platform, YakshaTech provides study organization, educational material processing, smart chat, flashcards, quizzes, and related features according to your plan.
The Platform is a study support tool. It does not replace formal instruction, official institutional materials, certified professional advice, or exam guarantees.
3. Eligibility and registration
You must have legal capacity to enter into agreements, or authorization from a legal guardian when applicable.
You agree to provide accurate registration information and keep your credentials confidential.
Each Account is personal and non-transferable. You are responsible for all activity under your Account.
By registering, you accept these Terms and the Privacy Policy, including the personal data processing described therein.
4. Plans, pricing, and payments
Some features may be offered free for a limited time or permanently, as shown on the pricing page.
Paid plans, when available, are billed according to prices and billing cycles displayed at purchase.
We may change prices, usage limits, and plan features with reasonable prior notice when changes affect active subscriptions.
Taxes and payment processing fees may apply under applicable law.
5. Acceptable use
You may not use the Platform to:
- violate laws, regulations, or third-party rights;
- upload unlawful, defamatory, discriminatory, violent, or infringing content;
- attempt unauthorized access to restricted areas, third-party accounts, or systems;
- reverse engineer, abuse scraping, overload systems, or bypass technical limits;
- use AI outputs for academic fraud, deliberate plagiarism, or integrity violations;
- resell, sublicense, or provide the Platform to third parties without authorization.
6. Intellectual property
The Gyeniusx brand, layout, software, visual identity, and other Platform elements belong to YakshaTech or its licensors.
You retain ownership of User Content you upload. By using the Platform, you grant us a limited, non-exclusive, revocable license to host, process, transform, and display that content solely to provide the contracted services.
Generated Content is provided for your personal study use. We do not guarantee exclusivity of AI outputs that may be similar across users.
7. AI and disclaimers
AI-generated content may contain inaccuracies, omissions, or outdated information. You must critically review all Generated Content before relying on it.
We do not guarantee academic results, grades, approvals, or specific outcomes from Platform use.
The service may be unavailable due to maintenance, technical failures, or third-party provider outages (including AI models, hosting, and storage).
8. Limitation of liability
To the maximum extent permitted by law, YakshaTech is not liable for indirect damages, lost profits, or data loss caused by misuse or events beyond our reasonable control.
Our total liability, when applicable, is limited to amounts paid by you in the last 12 months for your current plan, unless otherwise required by law.
9. Suspension and termination
We may suspend or terminate Accounts that violate these Terms, pose security risks, or are required by competent authorities.
You may close your Account at any time through available channels or support contact. Termination does not eliminate existing obligations or privacy rights.
10. Changes to these Terms
We may update these Terms periodically. The last updated date is shown at the top of this page.
Material changes may be communicated by email or in-app notice. Continued use after changes take effect constitutes acceptance, unless specific consent is required by law.
11. Governing law
These Terms are governed by the laws of Brazil.
Applicable consumer protection rules may determine jurisdiction for consumer disputes.
