Términos de Uso

1. Definiciones

"Plataforma": el sitio, aplicaciones y servicios digitales de la marca Gyeniusx, operados por YakshaTech.

"Usuario" o "tú": persona física que accede o utiliza la Plataforma.

"Cuenta": registro personal e intransferible creado por el Usuario.

"Contenido del Usuario": materiales que envías (PDFs, videos, textos, enlaces, notas, mensajes en el chat y otros archivos).

"Contenido Generado": respuestas, resúmenes, flashcards, cuestionarios y demás resultados producidos por la IA a partir del Contenido del Usuario.

2. Descripción del servicio

Through the Gyeniusx platform, YakshaTech provides study organization, educational material processing, smart chat, flashcards, quizzes, and related features according to your plan.

The Platform is a study support tool. It does not replace formal instruction, official institutional materials, certified professional advice, or exam guarantees.

3. Elegibilidad y registro

You must have legal capacity to enter into agreements, or authorization from a legal guardian when applicable.

You agree to provide accurate registration information and keep your credentials confidential.

Each Account is personal and non-transferable. You are responsible for all activity under your Account.

By registering, you accept these Terms and the Privacy Policy, including the personal data processing described therein.

4. Planes, precios y pagos

Some features may be offered free for a limited time or permanently, as shown on the pricing page.

Paid plans, when available, are billed according to prices and billing cycles displayed at purchase.

We may change prices, usage limits, and plan features with reasonable prior notice when changes affect active subscriptions.

Taxes and payment processing fees may apply under applicable law.

5. Uso aceptable

You may not use the Platform to:

• violar leyes, regulaciones o derechos de terceros;
• subir contenido ilícito, difamatorio, discriminatorio, violento o que infrinja propiedad intelectual;
• intentar acceder sin autorización a áreas restringidas, cuentas de terceros o sistemas;
• realizar ingeniería inversa, scraping abusivo, sobrecarga intencional o eludir límites técnicos;
• utilizar resultados de IA para fraude académico, plagio deliberado o violaciones de integridad;
• revender, sublicenciar o poner la Plataforma a disposición de terceros sin autorización.

6. Propiedad intelectual

The Gyeniusx brand, layout, software, visual identity, and other Platform elements belong to YakshaTech or its licensors.

You retain ownership of User Content you upload. By using the Platform, you grant us a limited, non-exclusive, revocable license to host, process, transform, and display that content solely to provide the contracted services.

Generated Content is provided for your personal study use. We do not guarantee exclusivity of AI outputs that may be similar across users.

7. Inteligencia artificial y exenciones

AI-generated content may contain inaccuracies, omissions, or outdated information. You must critically review all Generated Content before relying on it.

We do not guarantee academic results, grades, approvals, or specific outcomes from Platform use.

The service may be unavailable due to maintenance, technical failures, or third-party provider outages (including AI models, hosting, and storage).

8. Limitación de responsabilidad

To the maximum extent permitted by law, YakshaTech is not liable for indirect damages, lost profits, or data loss caused by misuse or events beyond our reasonable control.

Our total liability, when applicable, is limited to amounts paid by you in the last 12 months for your current plan, unless otherwise required by law.

9. Suspensión y cierre

We may suspend or terminate Accounts that violate these Terms, pose security risks, or are required by competent authorities.

You may close your Account at any time through available channels or support contact. Termination does not eliminate existing obligations or privacy rights.

10. Cambios en estos Términos

We may update these Terms periodically. The last updated date is shown at the top of this page.

Material changes may be communicated by email or in-app notice. Continued use after changes take effect constitutes acceptance, unless specific consent is required by law.

11. Ley aplicable

These Terms are governed by the laws of Brazil.

Applicable consumer protection rules may determine jurisdiction for consumer disputes.
